Welcome to Extremity AI! These Terms of Service ("Terms") govern your access to and use of the extremity.ai website (the "Site") and the conversational AI market intelligence services, features, content, applications, and products offered by Extremity AI ("we," "us," or "our") (collectively, the "Services").
Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, do not use our Services.
1. Eligibility and Account Registration
You must be at least 18 years old to use our Services. By agreeing to these Terms, you represent and warrant to us that you are at least 18 years old. If you are using the Services on behalf of an entity, organization, or company, you represent and warrant that you have the authority to bind that organization to these Terms and you agree to be bound by these Terms on behalf of that organization.
You may need to register for an account to access some or all of our Services. When you register for an account, you may be required to provide us with some information about yourself, such as your email address or other contact information. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times.
2. Subscriptions and Payment
Certain aspects of our Services may be provided for a fee or other charge. If you elect to use paid aspects of the Services, you agree to the pricing and payment terms, as we may update them from time to time. Extremity AI may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion.
All payments are processed through our third-party payment processor (e.g., Stripe). By making a purchase, you agree to be bound by the payment processor's terms of service and privacy policy. We are not responsible for errors by the payment processor.
Subscriptions may automatically renew unless canceled. You may cancel your subscription at any time through your account settings or by contacting us, subject to the terms of your subscription.
3. Use of Services
A. License to Use Services
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your internal business or personal purposes.
B. Prohibited Conduct
You agree not to misuse the Services or help anyone else to do so. For example, you must not try to do any of the following in connection with the Services:
- Probe, scan, or test the vulnerability of any system or network.
- Breach or otherwise circumvent any security or authentication measures.
- Access, tamper with, or use non-public areas or parts of the Services, or shared areas of the Services you haven't been invited to.
- Interfere with or disrupt any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any part of the Services.
- Access, search, or create accounts for the Services by any means other than our publicly supported interfaces (e.g., "scraping" or creating accounts in bulk).
- Send unsolicited communications, promotions or advertisements, or spam.
- Violate the law in any way, including storing, publishing or sharing material that's fraudulent, defamatory, or misleading.
- Violate the privacy or infringe the rights of others.
4. User Content and Data
You retain all rights to the data and queries you input into our Services ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute your User Content as necessary to provide and improve the Services.
We may use anonymized and aggregated User Content and data generated by the Services for research, development, and to improve our AI models and service offerings. We will not use your identifiable User Content for such purposes without your explicit consent unless otherwise stated in our Privacy Policy.
You are responsible for your User Content and you represent and warrant that you have all rights, licenses, consents, and releases necessary to grant the licenses granted in these Terms.
5. Intellectual Property
The Services, including the Site, our AI models, software, visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), and all other elements of the Services ("Materials") provided by Extremity AI are protected by intellectual property and other laws. All Materials included in the Services are the property of Extremity AI or its third-party licensors. Except as expressly authorized by Extremity AI, you may not make use of the Materials.
6. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EXTREMITY AI DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
THE INFORMATION AND INSIGHTS PROVIDED BY THE SERVICES ARE FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE CONSIDERED AS FINANCIAL, LEGAL, OR PROFESSIONAL ADVICE. YOU ARE SOLELY RESPONSIBLE FOR ANY DECISIONS OR ACTIONS YOU TAKE BASED ON INFORMATION OBTAINED THROUGH THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL EXTREMITY AI BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICES OR ANY MATERIALS OR CONTENT ON THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT EXTREMITY AI HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGE.
7. Indemnification
You agree to defend, indemnify, and hold harmless Extremity AI and its officers, directors, employees, consultants, affiliates, subsidiaries, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with (i) your access to, use of, or alleged use of the Services; (ii_ your violation of these Terms or any representation, warranty, or agreements referenced herein, or any applicable law or regulation.
8. Modification of these Terms
We reserve the right to modify these Terms at any time. We will post the revised Terms on the Site and update the "Last Updated" date. Your continued use of the Services after the effectiveness of such changes will constitute your acceptance of such changes. Please check these Terms periodically for changes.
9. Governing Law
